GTC – House rules

General terms and conditions

General / Scope of application

The following General Terms and Conditions (hereinafter referred to as “GTC”) apply to all services offered by Stargayte-Sauna GbR (hereinafter referred to as “Stargayte-Sauna”) in Leipzig and accepted by the visitor (hereinafter referred to as “Visitor”). Furthermore, the GTC apply to all other contractual and quasi-contractual relationships that exist between Stargayte-Sauna and the Visitor. When using the services offered by Stargayte-Sauna, these GTC are deemed to be bindingly agreed, unless otherwise agreed in writing with the managing director or prescribed by law. Any other terms and conditions are hereby rejected – subject to prior express written acceptance by Stargayte-Sauna.

Compliance with the conditions

The visitor is entitled to use the services of the Stargayte sauna to the agreed extent from the conclusion of the contract. The visitor undertakes to comply with the regulations of the house and usage rules displayed in the sauna as well as the instructions of the service staff. Bonus cards issued personally by Stargayte-Sauna are non-transferable; any transfer (in particular sale) is prohibited without the written permission of Stargayte-Sauna.

Transmen

The Stargayte Sauna is a men’s sauna where men can also have sex with men. In this sense, trans* men are of course also welcome with us. We know about the difficulty of self-perception — and external attribution and definition. At the same time, however, we need a practical, implementable solution for our company.
Access to the Stargayte sauna is thus granted to all persons who are perceived as men by our employees at the entrance in a dressed variant.
In addition, we do not make admission dependent on the presence of physical characteristics or official civil status. We also handle this with genderqueer guests who reject a binary determination for themselves. So it is possible that you will meet people with very different physical equipment in the Stargayte sauna. Here we ask all guests in every situation for a respectful interaction with each other. We know that we expect our guests to have an assessment of their body and their identity by our team. In the sense of our business model of a “Men’s sauna” we deliberately make this classification in order to focus our guests on a male spectrum. Whether you want to face this moment of foreign description as a trans*man or genderqueer person is up to you.

Transwomen

Since the Stargayte Sauna understands itself as a men’s sauna, trans*women have no access to us. However, there is our “Open Day” on Tuesday & Friday. This day is for all people – no matter what identity, genital equipment, sexual orientation etc. – e.g. women, trans, men and couples, tolerant heterosexuals, homo and bi people – who want to experience crackling eroticism in all their facets. Of course, there is no place for trans and homophobia here.

Opening hours

Stargayte-Sauna is entitled to change the opening hours at any time. All prices can be recalculated and adjusted by Stargayte-Sauna at any time.

Health, use of fitness equipment and sauna at your own risk

Visitors are fully responsible for their own state of health. The visitor affirms that he/she has no knowledge of any health or physical restrictions and/or is not taking any medication that would prevent him/her from using the sauna facilities. Acting against better knowledge and other self-harming behavior are at the expense of the visitor. The use of the sauna facilities of the Stargayte sauna is voluntary and at the visitor’s own risk.

Compensation for damages

Stargayte-Sauna reserves the right to claim damages in the event of misconduct on the part of the visitor. This applies, for example, to misuse of Internet access (use or download of illegal content, criminal behavior, etc.) or damage to the premises of the Stargayte sauna or its equipment and furnishings.
In the event of damage, loss or gross soiling of the following items, compensation must be paid in the amount of: 7,- € per pair of bathing shoes; 7.50 € per towel; 25,- € per locker key; 40,- € per cabin key; 20,- € per rinsing hose; 15,- € per blanket. For gross soiling of other items or the premises of the Stargayte Sauna, the responsible visitor must pay compensation of 50,- €.
For false alarms of the automatic fire alarm system triggered by gross negligence (in particular smoking tobacco products outside the authorized areas), we demand compensation of at least 950,- € for the deployment of the fire department, possible inspection of the detector and loss of income due to disruption of operations.
Stargayte-Sauna reserves the right to claim further damages. The visitor is free to provide evidence of lesser damages.

Data protection

Note according to § 33 BDSG: The name and address of the visitor and other necessary data are stored in automated files in the case of cashless payment. The data will not be passed on to third parties who have no connection with the use of the sauna/contract processing without the express consent of the authorized person.

Video surveillance

We would like to point out that the premises of the Stargayte sauna (in particular lockers, cash desk area, whirlpool, bar, entrances) are under video surveillance. Recordings will – insofar and as long as this is necessary in individual cases for the safety of our guests and for the investigation of criminal offenses – only be made available to the investigating authorities upon request. The recordings are treated confidentially, are technically secured and are not made accessible to visitors or staff. All video data will be deleted after 3 days at the latest. The relevant provisions of the Federal Data Protection Act are complied with.

Limitation of liability

Stargayte-Sauna or its vicarious agents shall only be liable for damages in connection with this contract, regardless of the legal grounds, in the event of intent or gross negligence. The exclusion of liability applies in particular to unforeseeable events, political influences, war and natural disasters. The limitation of liability does not apply to statutory liability for damages resulting from injury to life, limb or health. The amount of compensation is limited to the price of the arranged service. No liability is assumed for clothing and other items brought along, in particular valuables and money. The limitation of liability only applies insofar as nothing else is prescribed by law. Liability for more remote consequential damage or indirect damage is also excluded in the event of negligence.

Other provisions

For all disputes between the visitor and Stargayte-Sauna in Leipzig, regardless of the legal grounds, the place of jurisdiction is Leipzig, provided that the visitor is a merchant within the meaning of the German Commercial Code, the visitor has no general place of jurisdiction in the Federal Republic of Germany or moves his domicile or usual place of residence outside the area of application of the Code of Civil Procedure after conclusion of the contract or this is not known at the time the action is filed. German law applies exclusively to all disputes between the visitor and Stargayte-Sauna. The entrepreneur does not undertake to participate in dispute resolution proceedings before a consumer arbitration board.
Should individual provisions of these GTC be or become invalid, the remaining provisions shall remain valid.
